These General Terms and Conditions apply to all orders placed by consumers through the TheLastBoot online shop at https://thelastboot.com/.

2. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
By clicking the button „zahlungspflichtig bestellen“ (pay now), the customer submits a binding offer to purchase the goods in the shopping cart.
Receipt of the order will be confirmed immediately by email. This confirmation of receipt does not constitute acceptance of the offer unless acceptance is expressly declared therein. The contract is concluded as soon as we expressly accept the order by email or dispatch the goods.
3. Contract Language and Storage of the Contract Text
These Terms are made available in English and German for customer convenience. Mandatory consumer rights and other mandatory legal provisions applicable to the customer remain unaffected.
The contract text is stored by us after conclusion of the contract. The customer receives the order data, these terms, and the withdrawal instructions by email. Access to the contract text is possible for registered customers in their customer account; otherwise, the contract text is not accessible via our website after completion of the order.
4. Prices, Taxes and Shipping Costs
All prices are final prices in euros. No value-added tax is shown.
Additional shipping costs are shown separately before the order is placed. We offer free shipping on orders of EUR 50.00 or more.
5. Payment
We accept the payment methods displayed at checkout. The purchase price is due upon conclusion of the contract. If a payment service provider is selected, its terms also apply insofar as they are effectively incorporated into the payment relationship.
6. Delivery
Delivery is made only to delivery addresses in the countries currently available for selection at checkout.
Unless otherwise stated on the relevant product page or at checkout, delivery time is 3–8 working days.
Goods are dispatched from a warehouse within the European Union. No customs duties apply for deliveries within the European Union.

7. Right of Withdrawal
Consumers have a statutory right of withdrawal. Details, in particular the conditions, deadlines and consequences of withdrawal, as well as the model withdrawal form, can be found in our Withdrawal Instructions.
8. Voluntary 30-Day Return
In addition to the statutory right of withdrawal, we grant consumers a voluntary 30-day return option in accordance with our Returns & Refunds Policy. Your statutory rights, in particular the statutory right of withdrawal and statutory rights in respect of defects, are not restricted by this.
9. Retention of Title
The goods remain our property until the purchase price has been paid in full.
10. Statutory Liability for Defects and Guarantee
Statutory liability for defects applies. The statutory rights of the consumer in the event of defects remain unaffected.
Any guarantee exists only in accordance with the relevant guarantee terms. The consumer’s statutory rights in respect of defects remain in place free of charge and are not restricted by the guarantee.
11. Liability
We are fully liable for damage resulting from injury to life, body or health based on a breach of duty by us, our legal representatives or our vicarious agents, as well as for damage caused by intent or gross negligence, and under the Product Liability Act.
In the event of a slightly negligent breach of material contractual obligations, our liability is limited to the typical, foreseeable damage. Material contractual obligations are obligations whose fulfilment is essential for the proper performance of the contract and on whose compliance the customer may regularly rely.
Otherwise, liability is excluded.
12. Complaints and Dispute Resolution
Complaints can be sent to the email address stated in Section 1.
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

14. Applicable Law
These Terms shall be governed by the law applicable to the seller’s registered establishment, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions of the country of the consumer’s habitual residence provide otherwise.
The statutory places of jurisdiction apply for consumers. Consumers may bring claims against us in accordance with the statutory provisions, in particular at their place of residence or at our registered office. We may bring claims against consumers only before the courts at the consumer’s place of residence.
15. Final Provisions
Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.
